Nicole Wittstein is an associate in the Elias Law Group’s litigation practice, where she focuses on voting rights, election litigation, and other pro-democracy matters.
Nicole has experience litigating at all stages in state and federal court—from pleadings and motions practice through appeals, including appeals in the U.S. Supreme Court. Prior to joining the Elias Law Group, Nicole worked at McDermott, Will & Emery LLP as a member of the firm’s Supreme Court & Appellate Litigation and Government & Regulatory Litigation practice groups, where she specialized in high-stakes administrative and constitutional law matters against the federal government.
Nicole received her J.D., summa cum laude, from Duke Law School, where she served as Executive Editor of the Duke Law Journal and as a member of the Wrongful Convictions Clinic. With the clinic, Nicole helped successfully challenge a client’s 1976 conviction in North Carolina, resulting in his release after more than 44 years of wrongful imprisonment.
Nicole clerked for the Hon. Albert Diaz of the U.S. Court of Appeals for the Fourth Circuit and the Hon. Timothy J. Kelly of the U.S. District Court for the District of Columbia.
